Booking Terms and Conditions

These terms explain how a school workshop booking is made, what each party is responsible for and what happens if plans have to change.

1. About these terms

“Workshops for Schools” is operated by Jolly Good Productions, a partnership run by Ron and Hazel Wood in Richmond, North Yorkshire. In these terms, “we”, “us” and “our” mean Jolly Good Productions. “You”, “your” and “the school” mean the school, local authority, organisation or person making the booking.

These terms apply together with our written quotation and the information supplied in the completed booking form. If there is any inconsistency, any specific written term agreed with you will take priority.

2. Quotations and when a booking becomes binding

A quotation is based on the information available when it is issued and is subject to availability until the booking is made.

A booking becomes binding when we receive your completed booking form accepting the quotation and these Terms and Conditions, provided the quotation remains valid and the requested date has not already been withdrawn. We then enter the booking in our diary and send a written confirmation. The confirmation records the booking; payment or the later issue of an invoice does not create it.

Please check the quotation and confirmation carefully and tell us promptly if anything is incorrect.

3. Fees, invoices and payment

The fee and any travel, accommodation, materials or other agreed charges will be stated in the quotation. Unless stated otherwise, quotations are inclusive of all charges payable to us.

Schools and local authorities will normally be invoiced in accordance with the payment arrangements agreed in the quotation or their established purchasing procedures. Payment should be made by the due date shown on the invoice. The school must provide any purchase-order number or supplier information needed in sufficient time.

We may charge reasonable recovery costs and statutory interest on overdue business invoices where permitted by law.

4. Changes to a booking

Please contact us as soon as possible if you wish to change the date, times, venue, workshop, pupil numbers or other important details. A requested change is not agreed until we confirm it in writing. Changes may affect the fee and remain subject to availability.

A substantial change that we cannot accommodate may be treated as a cancellation by the school.

5. Cancellation by the school

If the school cancels, the following charge may be payable, calculated as a percentage of the total agreed fee:

We will take reasonable steps to reduce our loss. Any charge will be reduced to reflect costs saved or income received from a genuine replacement booking for the same date.

A postponement or change of date is not automatic. If we agree to transfer the booking, any costs already incurred and any revised fee will be confirmed in writing.

6. Cancellation or inability to attend by us

If illness, accident or another serious problem prevents Ron from attending, we will contact you as soon as reasonably possible. Where appropriate and with your agreement, we may offer a replacement date, an alternative suitable arrangement or a competent substitute.

If we cancel and no acceptable alternative can be provided, you will not have to pay for the cancelled service and any amount already paid for it will be refunded. Our liability for cancellation by us is limited as set out in section 14.

7. Weather, outdoor bookings and venue conditions

For any activity intended to take place outdoors, the school or organiser is responsible for providing a suitable wet-weather or indoor alternative, or arranging appropriate event-cancellation insurance.

Inclement weather does not itself cancel the booking or remove the obligation to pay. If we are ready, willing and able to provide the agreed service but weather, the absence of a suitable alternative space, or unsuitable venue conditions prevent or curtail it, the full fee remains payable.

We will not be required to perform where conditions are unsafe or could damage people, equipment or property. If severe weather or another circumstance prevents us from travelling to or attending the venue, we will seek a reasonable alternative arrangement under section 6.

8. Access, parking and facilities

The school must provide safe and timely access to the venue, suitable nearby parking for unloading, and any facilities or equipment identified in the quotation or booking information. Please tell us in advance about parking restrictions, stairs, security procedures, restricted access or other matters that could affect arrival and setup.

Where refreshments or a break are agreed for a full-day booking, the school should make suitable arrangements and provide access to drinking water and toilet facilities.

9. Timings and delays

The school must ensure that the venue and pupils are ready at the agreed times. If a delayed start, interruption or venue problem outside our control shortens the workshop, we will do what is reasonably possible within the remaining time, but the full fee remains payable.

Please allow the agreed setup and pack-down time and do not admit pupils to a setup area until it is safe to do so.

10. Supervision, safeguarding and behaviour

School staff remain responsible at all times for pupils’ supervision, safeguarding, behaviour, welfare and medical needs. An appropriate number of school staff must remain present and actively supervise throughout the visit.

Please tell us in advance about relevant accessibility, communication, sensory or learning needs in a proportionate way. Do not send unnecessary confidential or medical information about individual children through the website forms.

We may pause, adapt or stop an activity if behaviour or conditions create a safety risk. This will not amount to cancellation by us where the problem is within the school’s control.

11. Equipment, property and permissions

We remain responsible for our own equipment. The school is responsible for loss of or damage to our equipment caused deliberately or negligently by its pupils, staff or visitors, excluding fair wear and tear.

The school is responsible for obtaining any permissions needed for pupil participation and for ensuring that photographs or recordings are not made or published without appropriate consent. Recording an entire workshop requires our prior written agreement.

12. Circumstances beyond reasonable control

Neither party will be responsible for delay or failure caused by events genuinely beyond its reasonable control, except that this section does not remove payment obligations arising under section 7 where we remain ready, willing and able to perform.

The affected party must notify the other promptly and both parties should try to agree a reasonable alternative. If performance becomes impossible, sums due will be assessed fairly in light of services provided, costs incurred and losses avoided.

13. Concerns and complaints

Please raise any concern during the visit where possible so that we have an opportunity to address it. A formal complaint should be sent to ronwoodtd@gmail.com as soon as reasonably possible, with enough information for us to investigate and respond.

14. Liability

Nothing in these terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to that, we will not be liable for indirect or consequential loss, loss of profit, loss of opportunity, or loss caused by inaccurate information, inadequate supervision, unsuitable facilities or a failure by the school to follow agreed requirements.

Our total liability arising from a booking will not exceed the total fee payable for that booking, except where the law does not permit such a limit.

15. Personal information

We use personal information to handle enquiries, administer bookings, deliver services and maintain necessary business records. Further details are set out in our Privacy and Cookies notice.

16. General provisions

The booking is between the school or organisation named on the booking form and Jolly Good Productions. Neither party may transfer its rights or obligations without the other’s written agreement, except that we may use a suitable substitute where section 6 applies and you agree.

If any part of these terms is found unenforceable, the remaining provisions will continue. A delay in enforcing a right does not waive it. No person other than the parties has a right to enforce these terms.

17. Governing law

These terms and the booking are governed by the law of England and Wales. The courts of England and Wales will have jurisdiction over any dispute.
